This privacy policy (“Policy”) describes how MZ Wallace Inc. collects, uses, and discloses personal information and the choices you can make about your information. We respect your privacy and are committed to maintaining and using your information responsibly.

This Policy covers MZ Wallace’s consumer-facing operations and applies to personal information MZ Wallace collects in various contexts, including when you visit our website, visit out stores, call customer service, engage with us via social media, or participate in programs or surveys. MZ Wallace may provide additional or different notices in connection with specific programs or offerings.

“Personal information” is any information that identifies or reasonably could be linked to a particular person or household. It includes things like email addresses, phone numbers, mailing addresses, payment card information, account numbers, and government-issued identification numbers. These are just examples and there are many other types of information that would be considered personal information.

If you are a resident of California, Colorado, Virginia, or the European Economic Area, please see section 10 (CA), section 11 (CO and VA), or section 12 (EEA) for more information about additional rights you have.

  1. Information MZ Wallace Collects and Purpose for Collection.
    1. Information You Provide

      We collect personal information from you when you provide it to us in various ways; how we use it depends on the reason you provided it to us. The most common ways you may provide information to us are described below:

      • Account Creation. When you create an account via our website or with a phone/store associate, we collect your name, email address, password you select, and your month and date of birth. We also collect billing and shipping addresses and wishlist items if you add them to your account. We use this information to process any orders you place while logged into your account, for marketing and promotional purposes, and to develop and improve our products.
      • Online or Telephone Purchases. If you make a purchase through our website or by calling us, we will collect your name, email address, billing address, shipping address, and our payment card processor will process your payment card information. We will also keep a record of the products you purchased from us. We use this information to process your order and for accounting, tax, and business record purposes.
      • In-Store Purchases and Visits. If you visit or make a purchase in one of our stores, we may collect your name, email address, mailing address and a record of the products you purchased or inquired about, and our payment card processor will process your payment card information. We use this information for accounting, tax, and business record purposes.
      • MZW Rewards. If you choose to join our rewards program, you will create an account (see Account Creation above) and we will track your purchases, as well as your use of any points you earn. We use this information for marketing and promotional purposes and to develop and improve our products.
      • Contact Us. If you contact us by telephone, email, SMS text, chat on our website, send us a note through a form on our website or send us a message via social media, we will collect any personal information you provide to us. We use this information to respond to your inquiry.
      • Subscribe to Our Mailing List. We collect your email address if you subscribe to our mailing list and use it to send you information about our products and promotions.
      • Gift Cards, Gift Returns, or Store Credits. If you purchase or receive a physical or electronic gift card, we may collect your name, email address, shipping/billing address and our payment card processor will process your payment card information for the purchase. If you initiate a gift return or receive a store credit, we will collect your name, email address, and a record of the items returned and the reason for the return or store credit.
      • Contests, Giveaways, or Promotions. If you participate in one of our contests, giveaways or promotions, we will generally collect your name, email address, address, and any other information you provide to us.
      • Product Reviews. If you review an item on our website, we will collect your name, email address, and the content of your review.
      • Surveys. We may invite you to participate in voluntary surveys. We collect and analyze information voluntarily supplied via surveys to evaluate and improve our products and our services, to evaluate and develop marketing materials, campaigns and strategies, and for any additional purposes indicated in the specific survey or other request for information.
    2. Automatic Data Collection Technologies.

      Like many websites, MZ Wallace’s website uses certain technologies – cookies, web beacons, clear GIFs, tracking pixels, and similar technologies (collectively, “tracking technologies”) – to collect information when you interact with our website and email communications. These types of technologies are used to remember user preferences, maintain the security of our website and your account, measure website analytics, measure the effectiveness of our advertising and promotional communications, and gain information for marketing and advertising purposes, including by identifying the website from which a person was referred to MZ Wallace’s site and to track other websites visited by an individual.

      “Do Not Track” is a privacy setting that you may set in your web browser. If turned on, this setting requests that websites not track information about users.

    3. Video and Phone Recordings.

      If you visit one of our stores, we use closed circuit television and video recording for safety, security, and loss prevention purposes. If you call customer service, we may record those calls for quality assurance and training purposes.

    4. Information from Third Parties.

      Social Media. We may receive certain information about you from social media platforms. If you interact with us on social media or use features, such as plugins, widgets, or other tools made available by social media platforms (including Facebook, Twitter, and Pinterest) in connection with our website, we collect information that you share with us or that the social media platforms share with us. For more information about the privacy practices of those social media platforms, please review the privacy policies and settings of the social media platforms and networks that you use.

      Third-Party Tracking Technologies. We also permit third parties to use tracking technologies on our website to help us evaluate website and behavioral analytics, to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders. Some of these third parties use their technology to provide advertising about products and services tailored to your interests which may appear either on our websites or on other websites. You may also delete cookies placed on your device and block new cookies from being placed by using your internet browser’s privacy and security settings.

      Third-Party Partners. We sometimes partner with third parties to offer special promotions or events. In that circumstance, we may receive your personal information from our third-party partner (and we may also disclose your information to our third-party partner).

      Other Sources. We may obtain information about you from other sources, such as data analytics providers, marketing or advertising service providers, fraud prevention service providers, or publicly available sources.

  2. Use of Personal Information.

    MZ Wallace uses the personal information it collects or receives for various purposes including the following:

    1. Provide Products. MZ Wallace uses your personal information to provide its products to you, including to: fulfill your orders; process your payments; provide you with order confirmations and order updates; communicate with you regarding your account, purchases, returns, and exchanges; and provide customer service.
    2. Market and Promote MZ Wallace Products. MZ Wallace uses personal information to market and promote its products and service including for the purpose of: sending marketing, advertising, and promotional communications by email, text message or postal mail; displaying advertisements for products and/or services tailored to your interests on other websites (also called targeted advertising); measuring the effectiveness of our advertising and promotion communications; and administering contests or promotions.
    3. Improve and Personalize Your Experience. MZ Wallace uses personal information to: obtain and evaluate analytics data for the purpose of improving our product offerings; understand how you interact with our website, advertisements, and communications with you to determine which of our products are the most popular and to improve our website and marketing campaigns; save you time when you visit our website by remembering your preferences; personalize your experience with MZ Wallace and customize the marketing and advertising that MZ Wallace shows you; improve MZ Wallace’s understanding of customers’ needs; and provide personalized recommendations about our products.
    4. Prevent and Detect Fraud or Other Security Incidents. MZ Wallace uses personal information to prevent detect, investigate, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions, attempts to manipulate or violate our policies and terms, security incidents, and potential harm to the rights, property, or safety of MZ Wallace and its customers, employees, or others.
    5. Operate Its Business. MZ Wallace uses personal information to perform core business functions, including: maintaining records for accounting processes, loss and fraud prevention; collecting amounts owed to MZ Wallace; providing and maintaining the functionality of MZ Wallace’s website.
    6. Comply with Legal Obligations. MZ Wallace may use personal information to the extent needed to comply with its legal or regulatory obligations, to establish or exercise its rights, and to defend against a legal claim.
  3. Disclosure of Personal Information.

    MZ Wallace may disclose your personal information in certain circumstances, as described below.

    1. Service Providers. MZ Wallace utilizes other companies to perform certain services for it or on its behalf. These service providers may collect or receive your personal information so that they can provide services to MZ Wallace, which include:
      1. Processing credit or debit card payments;
      2. Shipping, handling, and delivering products you order;
      3. Providing marketing services (such as developing campaigns, sending emails or text messages, delivering advertisements);
      4. Hosting or maintaining our website, servers, databases, and/or software platforms;
      5. Providing fraud monitoring or detection services;
      6. Conducting surveys;
      7. Analyzing customer data and survey responses;
      8. Providing customer service; and
      9. Providing legal, accounting, or consulting services.
    2. Legal Compliance and Protection.We may disclose personal information in response to warrants, subpoenas, court orders, government investigations, or to comply with applicable laws and regulations. We may also disclose personal information to: establish, exercise, or protect the rights of MZ Wallace or its employees, affiliates, agents, and other customers; defend against a legal claim; protect the safety and security of our visitors; detect and protect against fraud; and take action regarding possible illegal activities or violations of our policies.
    3. Business Transactions.In the event we enter into a merger, are acquired, enter into bankruptcy, or sell a major part of our assets, your information may be among the assets transferred. To the extent we are able, we will notify the new owner of any restrictions placed on your information.
    4. Other Instances with Your Consent. MZ Wallace may disclose your personal information to other third parties not described above if you consent to such disclosure.
  4. Your Choices with Respect to Your Personal Information.
    1. Correcting Inaccurate Information. You may correct personal information associated with your MZ Wallace account by logging into your account and updating that information or by contacting our customer service department.
    2. Email Opt-Out. If you do not want to receive marketing or promotional emails from MZ Wallace, please click on the “unsubscribe” link at the end of one of our emails. You will be taken to a website where you can opt-out of future marketing emails. Please note that this will not opt you out of receiving transactional emails from us, such as order confirmations or shipment tracking information.
    3. Text Opt-Out. You can opt-out of receiving text messages from us at any time by replying to a text with the word “STOP.”
  5. Children’s Privacy.

    Our website is not aimed at or intended for children. MZ Wallace does not knowingly collect, receive, disclose, sell or share information from children under the age of 16. If we learn that we have inadvertently collected personal information relating to a child under the age of 16, we will delete that information from our records.   6. Security of Your Personal Information.

    MZ Wallace has implemented and maintains reasonable physical, technical, and organizational safeguards to protect your personal information from unauthorized access, acquisition, or disclosure, alteration, or destruction. Although we strive to keep your personal information secure, no safeguards can guarantee complete security, so you should exercise caution when transferring personal information over the internet. Please advise us immediately at help@mzwallace.com of any incident involving any unauthorized access to your account or unauthorized disclosure of personal information that is in our custody or control.

  7. Third-Party Sites.

    MZ Wallace’s website, emails or other materials may contain links or references to websites that are operated by other entities. Please note that when you visit other websites, you will be subject to the privacy practices and policies of the other site, which may be different from MZ Wallace’s practices. Please review the privacy notices for other sites you visit. MZ Wallace is not responsible for the content, technology, security, or practices of other websites.

  8. Updates to this Privacy Notice.

    MZ Wallace reserves the right to make changes to this Notice by posting an updated Notice on this website. Changes are effective immediately upon posting or upon a later effective date if one is indicated. You should review this Notice periodically to understand our current practices.

  10. California Residents’ Rights.

    The California Consumer Privacy Act (CCPA), California’s “Shine the Light” law, and the California Online Privacy Protection Act provide consumers who are California residents with specific rights regarding their personal information. If you are a California resident, this section provides you with additional information, describes your rights and explains how to exercise those rights.

      MZ Wallace does not collect or process sensitive personal information of California residents.

    2. Disclosure of Personal Information.

      MZ Wallace’s service providers collect or receive personal information in the course of performing service for or on behalf of MZ Wallace as described above. MZ Wallace discloses the following categories of personal information to the categories of recipients for a business purpose:

      • Identifiers: We disclose identifier information with our service providers, advertising networks, and social media platforms.
      • California customer records information: We disclose this information with our service providers, advertising networks, and social media platforms.
      • Characteristics of protected classifications: We disclose information with our service providers.
      • Commercial information: We disclose commercial information with our service providers, advertising networks, and social media platforms.
      • Internet or other similar network activity: We disclose internet activity information with our service providers, advertising networks, and social media platforms.
      • Geolocation data: We may disclose approximate physical location based on IP address with our service providers, advertising networks, and analytics providers. We may also disclose it to law enforcement if we believe the disclosure is appropriate to help detect, investigate or prevent fraud, theft, or other criminal activity.
      • Sensory data: We disclose this information with our service providers and we may disclose it to law enforcement if we believe the disclosure is appropriate to help detect, investigate or prevent fraud, theft, or other criminal activity.
      • Inferences drawn from other personal information: We disclose inference information with our service providers.

      We may also disclose these categories of information in connection with a business transaction or for legal compliance and protection, as described in section 3 above.

    3. Retention of Personal Information.

      MZ Wallace will only keep your personal information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as business records, tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, and we will make such determination based on applicable laws.

    4. Your Rights.

      Right to Correct Your Information. If you have an account with us, you can always correct your account information by logging in and updating your information. You may also submit a request to correct or update your personal information by submitting a request.

      Right to Access Information. Subject to certain limits, you may ask us to provide the following information:

      1. The categories of personal information we collected about you;
      2. The categories of sources from which the personal information was collected;
      3. The business or commercial purpose for collecting the personal information;
      4. The categories of third parties to which personal information was disclosed for a business purpose;
      5. The specific pieces of personal information we collected about you;
      6. Whether your personal information was sold or shared (“shared” in this context means sharing for the specific purpose of cross-context behavioral advertising) and, if so, the categories of personal information that was sold or shared, the categories of third parties to which your personal information was sold or shared, and the business purpose for the sale or sharing.

      Right to Delete. You have the right to ask us to delete any personal information that we have collected about you, subject to certain limitations as set forth under CCPA. We may deny your deletion request if the information is necessary for us or our service providers to, among other things, provide a good or service you requested, take actions reasonably anticipated in the context of our business relationship with you, perform a contract we have with you, detect and protect against security incidents or illegal activity, comply with a legal obligation, or exercise a right provided for by law.

      Right to Opt Out of Sale or Sharing. MZ Wallace does not sell your personal information for money; however, our use of third-party tracking and analytics technologies on our website may be considered a “sale” or “sharing” under California law. You can opt-out of being tracked by these third parties by submitting a request using the Do Not Sell or Share Personal Information link on our homepage. Please note that your use of our website may still be tracked by MZ Wallace and its service providers. You may also elect to block certain categories of cookies using our cookie consent banner or by using the Cookies Preferences link at the bottom of our home page. Finally, you may choose to delete cookies placed on your device and to block new cookies or just new third-party cookies from being placed by using your internet browser’s privacy and security settings.

      Categories of personal information disclosed that may be considered a “sale” or “sharing” under California law: identifiers including device information, IP addresses, and other unique identifiers; internet activity; and commercial data.

      Categories of third parties to which personal information was disclosed that may be considered “sale” or “sharing” under California law: advertisers and marketing partners, data analytics providers, and social media platforms.

      Right to Nondiscrimination. We will not discriminate against you for exercising your privacy rights under California law. The CCPA permits us to offer you certain financial incentives that can result in different prices, rates, or quality levels, which are related to your personal information’s value.

      MZ Wallace offers customers the opportunity to participate in the MZW Rewards loyalty program, which provides certain perks, such as free shipping and returns, early access to launches, and VIP events. When you sign up for the MZW Rewards program, we collect your name, email address, password you select, and your month and date of birth. We collect billing and shipping addresses if you add them to your account.

      We also offer a one-time 15% discount when you sign up for our email list. We collect your email for this purpose. You may unsubscribe at any time by clicking the “unsubscribe” link at the bottom of an email from us.

      Occasionally, we may provide other programs, such as sweepstakes, contests, or other similar promotional campaigns. When you sign up for one of these programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number).

      Because the programs described above involve the collection of personal information, they might be interpreted as a “financial incentive” under California law. The value of your personal information to MZ Wallace is based on the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense of offering those products, services, and benefits to Program participants. Participation in a program requires your prior opt-in consent, which you may withdraw at any time by submitting a request.

    5. Submission of Requests.

      If you are a California resident, you may submit a request, to correct, to access, to delete, or to opt out through any of the contact methods in section 9 above (How to Contact Us).

      Verifying Your Identity: To protect your privacy and security, we will take reasonable steps to verify your identity before providing your personal information, altering your personal information, or deleting your information. Only you or someone legally authorized to act on your behalf may make a request related to your personal information. For example, if you make a request, we will ask you to confirm your name, email address, or other information we have in our records to verify your identity.

      Requests from Authorized Agents: You may designate an authorized agent to make a request for you. If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent’s identity and contact information to us.

    6. Response to Requests.

      We will confirm receipt of your request within 10 business days of receipt and generally will respond to your request within 45 days of receipt. If we need more time to respond, we will inform you of the reason and we may take up to an additional 45 days to respond.

      You will not have to pay a fee to access your personal information or to exercise any of the other rights. However, we may charge a reasonable fee if your request is repetitive or excessive; alternatively, we may refuse to comply with your request in these circumstances.

  11. Colorado and Virginia Residents’ Rights

      1. Your Rights.

        Right to Correct Your Information. If you have an account with us, you can always correct your account information by logging in and updating your information. You may also submit a request to correct your personal information by submitting a request as described below.

        Right to Access Information. Subject to certain limits, you may ask us to confirm whether we are processing our personal information and to access any personal information we collect or process.

        Right to Portable Copy of Information. You have the right to obtain information you provided to us in a portable and, to the extent technically feasible, readily usable format.

        Right to Delete. You have the right to ask us to delete any personal information that we have collected about you. We may deny your deletion request if the information is necessary for us to, among other things, provide a good or service you requested or perform a contract with you, comply with applicable law or an investigation by a governmental authority, or prevent, detect, or respond to security incidents, fraud, theft, or illegal activity.

        Right to Opt Out. You have the right to opt out of the processing of your personal information for purposes of: (i) targeted advertising; (ii) sale of personal information; and (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

    (i) Targeted Advertising. MZ Wallace engages in targeted advertising based on your activities across internet sites and mobile applications. Personal data collected and used for this purpose generally includes device information, IP addresses, and other unique identifiers, approximate geographic location, and browsing information collected through cookies and other tracking technologies. This data is shared with our advertising and marketing partners. 

    (ii) Sale of Personal Information. MZ Wallace does not sell your personal information for money; however, our use of third-party tracking and analytics technologies on our website may be considered a “sale” under state privacy laws. Personal data collected and used for this purpose generally includes device information, IP addresses, and other unique identifiers, approximate geographic location, and browsing information collected through cookies and other tracking technologies. This data is shared with advertisers and marketing partners, data analytics providers, and social media platforms.
    You can opt-out of being tracked by these third parties by submitting a request using the Do Not Sell or Share Personal Information link on or homepage. Please note that your use of our website may still be tracked by MZ Wallace and its service providers. You may also elect to block certain categories of cookies using our cookie consent banner or by using the Cookies Preferences link at the bottom of our home page. Finally, you may choose to delete cookies placed on your device and to block new cookies or just new third-party cookies from being placed by using your internet browser’s privacy and security settings.

    (iii) Profiling In Furtherance of Decisions with Significant Legal Effects. MZ Wallace does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.

      1. Submission of Requests.

        If you are a Colorado or a Virginia resident, you may submit a request, to correct, to access, to obtain a copy, to delete, or to opt out by contacting us through any of the contact methods in section 9 above (How to Contact Us).

      2. Response to Requests.

        We will generally respond to your request within 45 days of receipt. If we need more time to respond, we will inform you of the reason and we may take up to an additional 45 days to respond.

    If we are unable to act on your request, our response will include the grounds for denying your request and how to appeal our decision.

    You will not have to pay a fee to access your personal information or to exercise any of the other rights. However, we may charge a reasonable fee if you or if your request is unfounded, excessive, or repetitive.

  12. EU Data Subject Rights

    The European Union’s General Data Protection Regulation and other countries’ privacy laws provide certain rights for data subjects. A good explanation of them (in English) is available at https://gdpr.eu.

    As noted above, this Privacy Notice is intended to provide you with information about what personal data MZ Wallace collects about you and how it is used. If you have any questions, please contact us at help@mzwallace.com.

    If you wish to confirm that MZ Wallace is processing your personal data, or to have access to the personal data MZ Wallace may have about you, please contact us through any of the contact methods in section 9 above (How to Contact Us).

    You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside MZ Wallace might have received the data from MZ Wallace; what the source of the information was (if you didn’t provide it directly to MZ Wallace); and how long it will be stored. You have a right to correct (rectify) the record of your personal data maintained by MZ Wallace if it is inaccurate. You may request that MZ Wallace erase that data or cease processing it, subject to certain exceptions. You may also request that MZ Wallace cease using your data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how MZ Wallace processes your personal data. When technically feasible, MZ Wallace will—at your request—provide your personal data to you or transmit it directly to another controller.

    Reasonable access to your personal data will be provided at no cost to MZ Wallace’s customers and others upon request made to MZ Wallace by contacting us through any of the contact methods in section 9 above (How to Contact Us). If access cannot be provided within a reasonable time frame, MZ Wallace will provide you with a date when the information will be provided. If for some reason access is denied, MZ Wallace will provide an explanation as to why access has been denied.
